  • Divorce is the legal termination of a marriage. Divorce is a ‘no fault’ system under The Family Law Act 1975. In order to apply for a Divorce, you and your partner must have been separated for at least 12 months and that there is no prospect or reasonable likelihood of reconciliation.

  • Separating is difficult. It is important that you put the needs of your children first. A Parenting Plan covers parental responsibility, who the child will live with, communication orders, processes for future disputes,

  • This is an agreement voluntarily entered into by both parties when an agreement about property settlement matters has been made.

  • This is a written agreement that it approved by the Court. A Consent Order can cover parenting arrangements for children as well as financial agreements such as property and maintenance. The Court must be satisfied that the agreement in place is just and equitable, and also in the best interests of any child.
